Client Bill of Rights & Responsibilities
| Our Commitment: At CHAH Technology, every client is entitled to dignity, respect, and meaningful participation in their own care. Our model integrates compassionate human care with AI-powered monitoring and predictive health technology. These rights establish the foundation of trust upon which that model depends. Your rights under this document are guaranteed regardless of how your care is delivered — by a person, by technology, or by both. |
Prior to the commencement of care, a CHAH Technology Care Coordinator or Registered Nurse will review this document with the client. The client, or their legally authorized representative (Power of Attorney for Personal Care, guardian, or substitute decision-maker), will acknowledge receipt in the Client Services Agreement and will be given a copy for their records. Access to care is based on the principle of non-discrimination.
Anyone with questions, concerns, or complaints regarding their rights and responsibilities has the right to contact CHAH Technology at info@chah.ai. You will be contacted within 72 hours regarding your concern, without fear of interference, coercion, discrimination, or reprisal, and CHAH Technology is committed to resolving all matters in a fair, efficient, and timely manner.
| Part I — Client Rights |
Right 1 — Right to Adequate and Compliant Care
You have the right to receive treatment, care, and services that are adequate, appropriate, evidence-informed, and in full compliance with all applicable provincial, federal, and local laws and regulations governing home and community care.
Right 2 — Right to Non-Discrimination
You have the right to receive services free from discrimination on any ground protected by the Ontario Human Rights Code and the Canadian Charter of Rights and Freedoms, including age, race, ancestry, place of origin, colour, ethnic origin, citizenship, creed, sex, sexual orientation, gender identity, gender expression, disability, family status, and socioeconomic status.
First Nations, Métis, and Indigenous clients have the right to receive services in a culturally safe and culturally responsive manner, and to have their traditions, practices, and healing preferences respected and integrated into their care plan where appropriate.
Right 3 — Right to Safety and Freedom from Abuse
You have the right to be free from mental, verbal, sexual, and physical abuse, neglect, involuntary seclusion, and exploitation by any CHAH Technology team member, technology system, care partner, or contractor. This protection applies equally in the context of AI-generated communications and automated system interactions.
Right 4 — Right to Dignity, Respect, and Individuality
You have the right for yourself and your property to be treated with full consideration, respect, and recognition of your human dignity, autonomy, and individuality — including your ethnic, linguistic, familial, cultural, and personal preferences. This right extends to the design and application of CHAH Technology’s AI systems, which are developed and governed to avoid reductive or discriminatory treatment of any client.
Right 5 — Right to Technology Transparency
| AI Governance Right: You have the right to know how artificial intelligence and predictive analytics are used in your care. This includes: what data is collected by in-home sensors and visual monitoring technology; how AI models analyse that data to generate risk predictions or care alerts; who receives AI-generated insights; and what actions may follow from those insights. You may request a plain-language explanation of any AI-generated alert, recommendation, or care flag affecting you at any time, without technical qualification required. |
CHAH Technology will not deploy new AI monitoring technology in your home without your prior informed consent. You will be notified of any material changes to the AI systems or monitoring tools used in your care, and given a reasonable opportunity to ask questions before those changes take effect.
Right 6 — Right to Human Oversight
| Clinical Primacy Right: You have the right to have all AI-generated recommendations reviewed and acted upon by a qualified health professional before any care decision is made. CHAH Technology’s AI functions as a decision-support tool — it augments clinical judgment; it does not replace it. No automated system will determine the course of your care without human clinical oversight. If you have concerns about how AI is being used in your specific care plan, you have the right to request a clinical review at any time. |
Right 7 — Right to Data Sovereignty
| Data Ownership Right: Your health data belongs to you. You have the right to access all personal and personal health information CHAH Technology holds about you, including AI-generated data, sensor logs, visual monitoring records, and risk-assessment outputs. You have the right to request corrections, withdraw consent for AI analysis or in-home monitoring at any time, and obtain a portable copy of your data upon request. Withdrawal of consent for AI or monitoring services does not affect your right to receive traditional care services. |
Right 8 — Right to Clear and Accessible Information
You have the right to receive clear, accurate, and accessible information about your services, including:
- The nature and scope of care being provided
- The specific technology, monitoring systems, or AI tools deployed in your home
- The identities and roles of all individuals responsible for your care
- Your rights under this document and under applicable law
- How to access complaints and feedback processes
Right 9 — Right to Access Your Care Plan
You have the right to access your care plan and care directives at any time through the CHAH Technology client and family portal. Your care plan reflects both clinical assessments and, where applicable, AI-informed recommendations that have been reviewed and approved by a qualified member of your care team. You may request a printed or accessible-format copy of your care plan at any time.
Right 10 — Right to Participate in Your Care
You have the right to participate fully in all aspects of your care, including:
- Initial assessment of your needs and goals
- Development, evaluation, and revision of your care plan
- Reassessment as your health status or circumstances change
- Decisions regarding the use or modification of AI-assisted monitoring in your home
You may designate a person of your choosing to be present during assessments, care visits, and care plan discussions, and to participate on your behalf in the development and review of your care plan.
Right 11 — Right to Know Your Care Team
You have the right to know the name, role, and qualifications of every individual responsible for your care. You also have the right to reach a CHAH Technology Care Coordinator or on-call nurse 24 hours a day, 7 days a week regarding your care. Contact information is available at chah.ai/contact-us/ and will be provided in your welcome package.
Right 12 — Right to Privacy and Confidentiality
You have the right to privacy and confidentiality with respect to all aspects of your care, services, and financial records. CHAH Technology’s collection, use, and disclosure of your personal and personal health information is governed by the Personal Information Protection and Electronic Documents Act (PIPEDA), the Personal Health Information Protection Act (PHIPA), and the CHAH Technology Privacy Policy, which is available at chah.ai.
Please advise CHAH Technology of any individuals with whom you do not wish your information to be shared, and this restriction will be formally documented in your file.
Right 13 — Right to Be Informed of Changes
You have the right to be informed, in writing or verbally, of:
- Planned changes to the frequency or nature of your care visits
- Material changes to your care plan or the technology used in your care
- Changes to payment arrangements, as soon as practicable and no later than 30 days after CHAH Technology becomes aware of the change
If CHAH Technology is unable to meet your care needs, you have the right to be referred to another appropriate home care provider.
Right 14 — Right to Itemized Billing
You have the right to receive fully itemized billing statements, including dates of service and unit charges, for any services billed by CHAH Technology. These are available upon request by the client or their authorized representative.
Right 15 — Right to Accept, Refuse, or Withdraw Services
You have the right to accept, refuse, or withdraw from any component of your care services or technology-enabled monitoring at any time. This includes the right to opt out of specific AI features while continuing to receive other care services. Where a client is incapable of exercising this right, an authorized substitute decision-maker may do so on their behalf.
Right 16 — Right to Accessible Documents and Coordinated Services
You have the right to request any document required by the Provincial Accessibility Standards for Customer Service in an accessible format, at no additional cost. Accessible formats include large print, electronic text, and audio, available upon request.
A client who receives more than one home and community care service has the right to receive assistance from CHAH Technology in coordinating those services to ensure coherence and continuity of care.
| Part II — Client Responsibilities |
To support the safe, effective, and respectful delivery of CHAH Technology services, clients are asked to accept and fulfil the following responsibilities:
- Provide express, informed consent before care, monitoring, or AI services commence.
- Provide complete, accurate, and up-to-date information about your health conditions, medications, allergies, hospitalizations, substance use, and any other matters material to your care.
- Notify CHAH Technology of any inability to keep a scheduled care visit with appropriate advance notice as outlined in your Service Agreement.
- Treat all CHAH Technology team members — including care workers, coordinators, and clinical staff — with respect and without discrimination, harassment, or violence.
- Cooperate with your care team and ask questions whenever instructions or information are unclear.
- Participate actively in the development, review, and ongoing revision of your care plan.
- Follow your agreed care plan and notify your care team promptly of any changes in your condition or preferences that may warrant a revision.
- Advise CHAH Technology of any individuals with whom you do not wish your information shared, so this can be documented in your records.
- Follow CHAH Technology’s feedback and complaint process when raising a concern, and engage constructively with the resolution process.
- Refrain from smoking during care visits.
- Maintain a safe working environment for all care providers visiting your home, including ensuring adequate lighting, clear pathways, and safe access to care areas.
- Keep pets away from care workers during home visits, unless prior arrangements have been made and documented.
Questions, Concerns, or Complaints
Any client, family member, or authorized representative with questions, concerns, or formal complaints regarding rights or responsibilities under this document may contact CHAH Technology through any of the following channels. All matters will be acknowledged within 72 hours and addressed without discrimination, interference, or reprisal.
